Terms And Conditions
By signing up to and/or using The Rentertainer web site you are agreeing to
abide by the following terms and Conditions.
These Terms and Conditions set forth the entire agreement regarding all the
subjects we discuss herein. If any provision of this agreement is found to be
unlawful, void, or unenforceable, it will not affect the validity and
enforceability of any other provision.
The Rentertainer reserves the right to modify these conditions from time to
time. You will be notified of any changes by way of email to the address listed
in the "My Settings" section of the web site.

In signing up to The Rentertainer you are certifying that you are at least 18
years of age and hold a valid credit card. If you are under 18 you can become a
member by having a parent or guardian sign up for you.
Membership to The Rentertainer is only open to Australian residents and games
will not be mailed outside of Australia.
Privacy
All information provided to The Rentertainer by members is treated with the
utmost confidentiality and will not be released to any other parties unless
required by law or to The Rentertainer's or client's bank for the purpose of
settling a credit card chargeback or dispute.
You are solely responsible for maintaining the confidentiality of your account
information, including your password, and restricting access to your computer.
By using The Rentertainer you agree to accept responsibility for all activities
that occur under your account or password.
For your protection credit card and billing details are not stored on this site
and all credit card entry screens use secure 128 bit encryption.
We will never send you and email asking for your password or credit card
details, should you ever receive and email asking for personal details then we
suggest that you do NOT click on any links within the email. Instead we suggest
that you MANUALLY log onto our site where you will receive an automated
announcement if any information is required. We strongly recommend that you
apply these precautions to any site or service that asks for your personal
details, particularly banking sites.
Game ownership
All games are owned by The Rentertainer and ownership remains with The
Rentertainer when games are loaned.
Membership and Billing
You are required at all times to maintain valid and current credit card details
with The Rentertainer and to have sufficient credit available in the account by
the due date to permit a direct debit in accordance with these terms. This
includes keeping up to date the expiree date, credit card number and any other
details that may affect our ability to charge any amounts owed by you. If you
fail to keep any information up to date then you agree to pay all bank charges
and fees which may result from the rejection and/or resubmission of your
monthly charges to the bank.
Membership and Fees
As a member of The Rentertainer, you agree that we are permitted to charge your
credit card on a monthly basis for your membership fee and any other charges
you may incur in connection with your use of The Rentertainer. The membership
fee will be billed in advance on the first business day of each month, unless
and until you cancel your membership. If you join part way through a month you
will be immediately billed for the remainder of that month to bring you into
line with our normal billing period, after which you will be billed on the fist
business day of each month. We reserve the right to change our fees, but we
will notify you in advance if we do so.
By signing up to TheRentertainer you acknowledge that we will pass on all fees
and charges that are incurred in the collection of any out standing moneys and
that you agree to pay these fees and charges. This includes, but is not limited
to, any fees or charges resulting from the use of a debt collection service to
recover unpaid membership fees or retrieve any games or equipment that have not
been returned at the termination of your membership. You further acknowledge
that TheRentertainer has the right to forward on the details of any misuse your
credit card to the relevant authorities and that the failure to return games at
the end of your membership may be reported to the authorities as theft of
TheRentertainer property.
Lost/Unreturned/Damaged Games
You agree to allow us to charge your credit card for up to the full recommended
retail price of a game in the following situations:
If you have not returned a game to us within 7 days of cancelling your
membership,
If you have lost a game and reported it to us as lost, or
If you have damaged a game and reported it to us as damaged.
Credits and Bonuses
From time to time The Rentertainer may issue a credit or bonus to your account.
These credits will be offset against your monthly membership fees and not
refundable for cash. All unused credits will be forfeit upon cancellation of
your membership.
Gift Vouchers
By redeeming a gift voucher you agree to abide by these terms and conditions as
well as the Gift Voucher Terms and Conditions.
Special referral program terms and conditions
By using the referral program you are agreeing to the following conditions.

You agree not to send unsolicited or spam mail to promote The Rentertainer.
Anyone caught doing so will forfeit all referral credits and will be exclude
form using the referral program. Repeated attempts may result in the cancelling
of your membership.

The $5 credit is applied to your future membership fees and is not redeemable
for cash.

The person you sign up must remain a fully paid up member for at least two full
months.

The credit will be applied to your account after the person you signed up has
completed their second month's membership.

Any fraudulent activity or credit card chargeback's by the person you signed up
will result in the cancelling of the referral credit.

Any fraudulent or illegal activity by you in conjunction with this site will
result in the removal of all credits and cancelling of your membership.
Cancellation of Membership
You may cancel your subscription to The Rentertainer at anytime. Your account
will be deemed as cancelled at the end of your current billing cycle, you will
be given seven (7) days from that date to return any outstanding rentals.
Failure to return such rentals will result in you being billed the full
replacement cost for each outstanding item.
Any credits remaining in your account at the time of cancellation will be lost
and are non refundable.
Limitations on Liability
The contents of The Rentertainer site and the games we deliver are provided "as
is." We make no representations or warranties, whether express or implied, of
any kind about their accuracy or functionality. We assume no liability or
responsibility for any errors or omissions in the content of The Rentertainer
site, for any failures, delays, or interruptions in the delivery of any content
contained on The Rentertainer site, for any losses or damages arising from the
use of the content provided on The Rentertainer site, or for any conduct by
users of The Rentertainer site.
You agree that The Rentertainer makes no representations or warranties other
than those required by Australian law and that all liabilities will be limited
to the replacement, resupply or refund of service or goods.
You acknowledge that the games and information on The Rentertainer web site are
supplied by other parties and as such The Rentertainer is not responsible for
the accuracy or quality of the information supplied.
